--SC allows Adani Cementation to cut mangrove trees for jetty construction

NEW DELHI – The Supreme Court on Monday allowed Adani Cementation Ltd. to cut 158 mangrove trees for its proposed jetty project along the Amba river in Maharashtra's Raigad district. The jetty construction project will help transport cement, clinker and other raw material through waterways along with a conveyor corridor and an approach road to the proposed cement grinding and fly ash processing unit to meet the increasing demand for cement in the Mumbai Metropolitan Region.

Upholding the Bombay High Court's order, the bench led by Chief Justice of India B.R. Gavai dismissed a petition by the Bombay Environmental Action Group. The petitioner is an environmental non-government organisation founded in 1979 by a group of professionals, artists, nature enthusiasts and entrepreneurs in Mumbai who were concerned about the impact of industrial and residential development on the environment and local populations.

The case has its genesis in Adani Cementation conceptualising setting up of a cement manufacturing unit along the Amba river in Shahapur and Shahabaz in Raigad district. This unit was set up considering the large cement demand in the coastal areas and in view of the congestion of roads in Mumbai Metropolitan Region. The jetty project, with an estimated total cost of around INR 1.72 billion, was to help reduce the overall pollution and to accelerate the infrastructure development in Mumbai, and hence was in larger public interest, argued Adani Cementation.

The high court had in March rejected the contention by the Bombay Environmental Action Group that the project was not in public interest and there was an alleged discrepancy regarding the land used by the project site under Coastal Regulation Zone regulations. The high court had held that it found no difficulty in granting the requisite permission to Adani Cementation as the requisite statutory permissions were granted in favour of the project, subject to strict compliance of the conditions ensuring protection of ecology and environment.

Earlier, the National Company Law Tribunal had approved the merger of Adani Cementation Ltd. with Ambuja Cements Ltd., which will help consolidate Adani group's cement business under one unit. At 1342 IST, shares of Ambuja Cements were up 2% at INR 609 on the National Stock Exchange. End
